This Privacy Policy (the "Policy") describes how personal information is collected from users of Oomble's website at www.oomble.com (the "Site"), and how that information is used and shared. By using our Site and/or Oomble’s services (the “Services”), you consent to the terms of this Policy.

1. Age Restrictions
This Site is not designed or intended to collect and retain personal information from children who are under 13 years of age, and you must be 18 years of age or older or have a legal guardian register an account to use the Services. While there may be limited activities available on the Site (such as the blog) that do not require an account and are therefore open to the public at large, including children under 13, we do not and will not knowingly collect and retain information from children under 13.

2. What is Personal Information?
Personal information specifically identifies an individual, such as an individual's name, address, telephone number, e-mail address, credit card or other account number—and information about that individual's activities when directly linked to him or her, such as information about his or her purchases.

Personal information also includes demographic information, such as date of birth, gender, geographic area and preferences when such information is linked to other personal information that identifies an individual.

Personal information does not include "aggregate" information. Aggregate information is data collected about a group or category of products, services or customers from which individual customer identities have been removed. In other words, information about how you use a service may be collected and combined with information about how others use the same service, but no personal information will be included in the resulting data. Aggregate data helps us understand trends and customer needs so that we can better design new products and services, and refine existing products and services to serve our customers better.

3. We Do Collect Certain Personal Information
Due to the nature of the Web, your mere visit to and use of the Site (and any other web site) results in certain data that is provided to our web servers. Such data includes, for example, your computer's operating system and browser type, version, and capabilities (such as whether JavaScript is enabled and cookies are accepted), your IP address, the time and date of your visit, the referring site (if applicable), as well as screen resolution, color and depth. Such data does not necessarily enable us to personally identify you (e.g., without purposefully trying to link your personal information with your IP address) and it is not our intention to use such data to try to personally identify you. We do, however, collect personal information about you, such as your name, email address, cell phone number, cell phone carrier, billing address, credit card number and expiration date, and demographic information but only if you voluntarily provide it by registering an account with us. In addition to registering an account with us, you also provide us with personal information when you:

  • contact us by email for any reason, such as to request help with the Services, or to provide us with your comments and/or feedback;
  • submit a resume to us via email;
  • provide personal information, including demographic information in connection with your participation in any survey or contest on the Site; or
  • post personal information on our blog or in other forums or interactive areas on the Site.

4. We Use Cookies
To facilitate your use of the Site, Oomble uses “cookies.” A cookie is a small file that is stored on your computer and is sent to Oomble’s server whenever you visit a new page on the Site. When you log onto the Site, the cookie file captures your username, unique session identifier number and other session data to enable you to traverse through the Site’s various pages without having to authenticate yourself at each new page. We use cookies to keep you logged in to the Site, to count the number of unique computers visiting the Site, and to record your user preferences.

5. Our Use of Personal Information
In general, we use personal information collected on the Site to provide the Services, to provide support for the Services, to respond to user requests and inquiries, to maintain a record of our dealings with our users, to develop new services and to inform users about services we think will be of interest.

For example, we use your information to process purchases or delivery of web content that you may make through the Services, to communicate with you about such purchases and/or use of the Services, to provide support in response to your inquiries, to send you promotional materials via email, to improve our services and to develop new services. You may opt-out of receiving some or all non-Service related communications by updating your profile on the Site, however, we need to be able to communicate with you regarding the Services, so you cannot opt out of those communications (although you always have the right to cancel your account with us and stop receiving our Services and such communications).

6. Sharing of Personal Information
We need to reserve a right to disclose your personal information to third parties from time to time in our sole discretion. However, we do not intend to sell or rent personal information to third parties for profit nor do we intend to share your personal information for reasons other than to provide you the Services. Our primary purpose for sharing personal information is to provide such personal information to our third-party partners who assist us in performing internal functions necessary to operate our business. For example, in order to deliver web content that you have purchased to your cell phone, we may need to provide your cell phone number to our mobile aggregator in order to transmit an SMS message sent to your cell phone. We may also share personal information with our third-party partners who analyze traffic information or other data, provide marketing assistance, and process credit card transactions. We will do our best to limit the information shared with our third-party partners to that which is necessary to carry out their functions. Additionally, Oomble may disclose your personal information as it believes is reasonably necessary to comply with law, regulation or other governmental authority or to prevent harm to yourself or others. Oomble may also disclose your personal information upon a transfer or sale to another entity of all or substantially all of Oomble’s stock or assets in Oomble’s line of business to which this Policy relates or upon any other corporate reorganization.

7. Links to Other Web Sites
The Site may contain links to other Web sites and the Services may provide access to content hosted on other Web sites. For example, the Services may enable you to access the photos that you manage and store at your preferred online photo management site (via such site’s API). Access to content residing on other sites and links from our Site to other sites are provided for your convenience only, and we do not have control over the content or privacy and security practices and policies of such third parties or other sites. Any personal information you provide to such other third party sites is provided directly to that third party and is subject to that third party's privacy policy. We encourage you to learn about their privacy and security practices and policies before providing them with personal information.

8. Security
We have put into place reasonable security measures in an effort to prevent loss, misuse and alteration of information while it is under our control. We cannot, however, guarantee the protection of information against interception, misappropriation, misuse or alteration, nor can we promise that your information may be not be disclosed or accessed by accidental circumstances or by the unauthorized acts of others. Furthermore, we have no control over the security of other sites you might visit, interact with or do business with. Orders placed on our Site are protected by the Secure Sockets Layer (SSL) protocol to ensure privacy and security of your ordering and payment information. We also use encryption or hashing technologies to protect billing information and user passwords that we retain (i.e., we do not actually know and cannot provide your password to you).

9.Public Forums
Oomble may make available blogs, chat rooms, forums and message boards on the Site. Any information disclosed in these areas, or otherwise submitted to Oomble for publication, becomes public information. Please use extreme caution when disclosing personal information through any of the above-mentioned communication mechanisms.

10. Choice
To opt-out of receiving marketing or other promotional communications from us, or to access, change or delete your personal information maintained by us, you may (1) opt-out by modifying your preferences in your profile; or (2) email us at support@oomble.com.

11. Policy Changes
We will modify this Policy if our privacy practices materially change in the future and we will notify you of such changes only by posting the modified Policy on our Site and indicating at the top of the Policy the date it was last updated. We encourage you to review this Policy when you visit our Site to see if it has been updated since your last visit and to make sure you understand how information you provide will be used.
